On October 23, 24 and 25 of 2015 Don Yearin and the Yearin Law Group had three successful mediations involving wrongful death cases which resulted in three substantial settlements, two of which are confidential. One case involved a driver who was driving the wrong way on State Route 51 in Phoenix, Arizona with a blood alcohol level of .241, more than three times the lawful limit. Cocaine was also found to be in the defendant’s blood. The head-on accident caused the death of a terrific mother/daughter and business executive. The settlement amounted to $975,000.00 and would have been more had there been additional insurance available.
The second case was a medical malpractice claim involving a client who was on Hospice due to metastasized breast cancer. The defendant’s made numerous mistakes managing her pain which caused a horrific and premature end of life passing.
The third claim involved our 17 year old client who tragically lost her 53 year old Mother who committed suicide. Twelve days before the suicide, the Mother had attempted suicide via an overdose and was admitted to an in-patient treatment center. She was released to her second husband who was 76 years of age. The second husband was advised to lock up all prescription medications and to remove all firearms from his home. He failed to do so and the Mother committed suicide eight days after being released from the in-patient treatment facility. What made the case more egregious was that the second husband attempted to deprive our client of the inheritance which her Mother wanted her to have, including keepsake items such as her Mother’s jewelry and favorite sweatshirt. Attempting to deprive a 17 year old girl of her inheritance when she just lost her Mother was unconscionable and inexcusable.
